Welcome to Vitaris. By using our products and services, you agree to these terms. Please read them carefully.
1. Acceptance of Terms
By accessing and using any Vitaris product — including Vitaris App and Vitaris Health — you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
These Terms apply to all users of our services, including administrators, team members, and any person who accesses the platform under your account.
2. Service Description
Vitaris is a technology company that provides digital solutions for professionals in the insurance and health sectors. Our current products include:
- Vitaris App: A CRM platform for insurance advisors and agencies to manage clients, policies, claims, renewals, commissions, and reports.
- Vitaris Health: An appointment and patient management platform for clinics and medical practices to manage scheduling, patient records, billing, and clinical workflows.
Access is provided through subscription plans or custom agreements as determined by Vitaris.
3. Account Registration
To use our services, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep it updated.
You are responsible for safeguarding your account credentials and for any activities under your account. You must notify us immediately of any unauthorized access at hello@getvitaris.com.
4. Subscriptions and Payments
Our services may be billed on a subscription basis. Billing cycles and pricing are determined by the plan you select or the custom agreement established with our team.
We reserve the right to modify our subscription rates. Any price changes will be communicated to you with at least 30 days' notice before taking effect.
Payments are processed through secure third-party providers. Refund policies are determined on a case-by-case basis or as specified in your service agreement.
5. Acceptable Use
You agree to use Vitaris only for lawful purposes. You agree not to:
- Upload or transmit content that is illegal, harmful, or infringes on the rights of others.
- Interfere with or disrupt the services or servers.
- Attempt to gain unauthorized access to any part of the platform.
- Use the services to send spam or unsolicited communications.
- Store or process personal data of third parties without proper legal basis or consent.
- Violate any applicable local, national, or international law.
6. Data Responsibility
When using Vitaris products, you may enter, store, or process personal data of your clients, patients, or other third parties. In this context:
- You are the data controller responsible for the lawfulness of data collection and processing.
- Vitaris acts as a data processor, handling data solely to provide the contracted services.
- You are responsible for obtaining appropriate consent from your clients or patients before entering their data into the platform.
- For Vitaris Health users: you must comply with all applicable health data regulations in your jurisdiction when processing patient information.
7. Intellectual Property
The platform and its original content, features, and functionality are owned by Vitaris (operated by Dizblanc LLC) and are protected by international copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the services in accordance with these Terms.
8. User Content
You retain ownership of any content you upload or create using our services. By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display such content solely for the purpose of operating and delivering our services.
You are responsible for the content you upload and must ensure you have the necessary rights to use and share it.
9. Service Availability
We strive to maintain high availability of our services but do not guarantee uninterrupted access. We may perform scheduled maintenance, and in exceptional circumstances, unplanned downtime may occur.
We will make reasonable efforts to notify you of planned maintenance windows in advance.
10. Disclaimers and Limitations of Liability
The services are provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the services will be uninterrupted, timely, secure, or error-free.
Vitaris is a technology tool and does not provide insurance, medical, legal, or financial advice. Users are solely responsible for their professional decisions and compliance with industry regulations.
To the maximum extent permitted by law, Vitaris and Dizblanc LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses resulting from your use of the services.
11. Termination
We may terminate or suspend your account and access to the services immediately, without prior notice, if you breach these Terms or engage in behavior that is harmful to other users or the platform.
You may cancel your subscription at any time. Upon cancellation, your access will continue until the end of your current billing period. After that, your data will be retained for 90 days before deletion, unless a different retention period is specified in your agreement.
12. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by email or through the services at least 15 days before they take effect. Your continued use of the services after such modifications constitutes acceptance of the updated Terms.
13. Governing Law
These Terms shall be governed by the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Dizblanc LLC is a Wyoming-registered limited liability company. Any dispute arising from these Terms shall be resolved in the courts of Wyoming.
